Welcome to LakbayGo. By using our mobile application and services, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. The Service

LakbayGo Tech Solutions, Inc. ("LakbayGo") provides a digital platform that connects passengers ("Users") with independent third-party transport providers ("Drivers").

Legal Disclaimer: LakbayGo is a Transport Network Company (TNC). We provide the technology to facilitate the ride; we do not provide transportation services ourselves. The Driver is responsible for the transportation service.

2. User Eligibility

• You must be at least 18 years old to create an account.
• Minors may only use the service if accompanied by an adult or via a "Family Account" managed by a parent/legal guardian.
• You agree to provide accurate and complete information (Name, Mobile, Payment Info).

3. Payment and Cancellations

• Fares: Fares are calculated based on distance, time, and traffic, subject to LTFRB-approved fare structures.
• Taxes: All fares are inclusive of applicable Philippine taxes (VAT).
• Cancellations: We reserve the right to charge a "Cancellation Fee" if you cancel a ride after a Driver has already been dispatched or if you fail to show up at the pick-up point.
• UnionBank Integration: All digital payments are processed via our secure partners.

4. Conduct and Safety

• User Conduct: You shall not cause nuisance, annoyance, or property damage to the Driver or the Vehicle.
• Prohibited Items: Users are prohibited from bringing illegal drugs, flammable materials, or unregistered firearms into the vehicle.
• Emergency Button: Our app includes an "S.O.S." feature. Misuse of this button for non-emergencies may lead to permanent account suspension.

5. The Driver-Partner Relationship

• Independent Contractors: You acknowledge that Drivers are independent contractors and not employees, agents, or representatives of LakbayGo.
• LakbayGo is not liable for the acts, errors, omissions, or negligence of any Driver. However, we maintain a "Quality Assurance" protocol and will investigate all reports of misconduct.

6. Limitation of Liability

To the extent permitted by Philippine law, LakbayGo shall not be liable for any indirect, incidental, or consequential damages arising out of the use of the Platform. Our maximum liability is limited to the total fare of the specific trip in question.

7. Intellectual Property

The "LakbayGo" name, logo, and software are the exclusive property of LakbayGo Tech Solutions, Inc. Any unauthorized "reverse engineering" or cloning of the app is strictly prohibited and will be prosecuted under the IP Code of the Philippines.

8. Dispute Resolution and Governing Law

• Governing Law: These terms are governed by the laws of the Republic of the Philippines.
• Venue: Any legal action arising from these terms shall be filed exclusively in the courts of Iloilo City, to the exclusion of all other venues.
