This Privacy Notice ("Notice") explains how LakbayGo Tech Solutions, Inc. ("LakbayGo", "we", "us", or "our") collects, uses, processes, and protects your Personal Data. This applies to all users of our mobile application, website, and portals (collectively, the "Platform") and our ride-hailing and logistics services ("Services").

This Notice applies to our passengers ("Consumers") and our driver-partners ("Partners").

I. Collection of Personal Data

We collect Personal Data to provide a seamless and safe ride-hailing experience.

1. Data you provide to us

• Account Information: Name, contact number, email address, and profile picture.
• Verification Data (For Partners): Driver's license, vehicle registration (OR/CR), NBI clearance, and "selfie" for liveness checks.
• Payment Information: Credit card details or e-wallet links (processed via our secure payment partners like UnionBank).

2. Data collected during use of Services

• Location Information: Precise GPS data to connect passengers with the nearest drivers and to track trips for safety.
• Transaction Data: Details of the rides taken, amount charged, and payment method used.
• Device Data: IP address, device hardware model, and operating system.
• Telematics (For Partners): Data on braking, acceleration, and speed to ensure safety standards.

3. Data from other sources

• Referral programs, insurance providers, and government regulatory bodies (e.g., LTFRB).

II. Use of Personal Data

We process your data based on your consent, our contract with you, or our legitimate business interests:

• Service Delivery: Processing your ride requests and facilitating payments.
• Safety and Security: Real-time trip monitoring, identity verification, and the "Emergency Button" feature.
• User Support: Investigating and resolving complaints or "Lost and Found" items.
• Legal Compliance: Complying with LTFRB regulations, court orders, and tax requirements (BIR).

III. Disclosure of Personal Data

We do not sell your data. We only share it with:

• Other Users: We share the Passenger's name and pick-up point with the Driver; we share the Driver's name, photo, and vehicle details with the Passenger.
• Service Providers: Cloud storage (e.g., AWS/Google Cloud), payment processors, and SMS notification gateways.
• Government Authorities: When required by law or to ensure public safety.

IV. Data Retention and Protection

• Retention: We keep your data as long as your account is active. Certain data (like transaction history) is kept for up to ten (10) years to comply with Philippine tax and transport laws.
• Protection: We implement technical measures like SSL encryption and restricted access to our servers. However, no internet transmission is 100% secure.

V. Your Rights as a Data Subject

Under the Philippine Data Privacy Act, you have the right to:

1. Be informed if your data is being processed.
2. Access and request a copy of your data.
3. Correct any errors in your information.
4. Object to processing or Withdraw Consent (this may limit your use of the app).
5. Erasure or Blocking of your data from our system.
